The navigation and/or purchase of any product through the above website and ecommerce implies your agreement to these Terms. If you disagree with any part of the Terms, then, you will not be able to access the service.

ONLINE SHOP OWNERSHIP

 The domain and ecommerce available on www.bohochick.online (mention below as “online shop” or “website “) is property of Vanessa Chatterley Rebelo, owner of the trademark and physical shop BOHOCHICK situated at Galerias São Lourenço, Avenida da Arriaga N.41, 9000-060 Funchal, Portugal.

APPLICABITITY

 The present General Conditions apply and regulate all website navigation, the act of purchase and sale, between a singular person with mere personal interest, as a final consumer with no intentions of resell of the articles purchased (named as “user”, “customer” or “client”), and BOHOCHICK the responsible part for selling it´s products through this online shop. The User/ Client compromises in using this website according to the law and regulations applied.

INTELLECTUAL PROPERTY

  1. It is considered Intellectual Property of BOHOCHICK all the references on the website, including materials, products, text, graphs, information, content, images, illustrations, drawings, icons, photographs, video clips, art and other materials and copyright, trademarks, visual identity and/or other intellectual property rights in such materials are owned and licensed by Vanessa Chatterley Rebelo and therefore protected by the Intellectual Property Rights and Industrial Property Rights.

  2. Any violation of the above will be sanctioned by Vanessa Chatterley Rebelo with suspension of service and owners account, followed by legal action to safeguard Vanessa Chatterley Rebelo and the creative collaborators rights and interests with act for compensation due to moral and monetary damage.

ALTERATIONS

BOHOCHICK reserves the right, exclusively under our discretion, to modify or replace these Terms at any given moment, in order to update current legislation.

It reserves yet the right to alter without previous notice the presentation and content of the website’s products, prices promotions, commercial conditions and services. These alterations will serve for an improvement of our website and simultaneously improve our service to the customers.

COMMERCIAL POLICY

The articles ordered through purchase in the website are of BOHOCHICK property until made full payment of the given article.

PRODUCTS INFORMATION

 BOHOCHICK aims to be the most reliable possible in photographing our products and adding the essential description of the articles. However please consider that they might be slight changes in colour and shape due to different monitors or navigations used. Therefore we recommend the Client to carefully consult all the images and details illustrating the item of purchase.

BOHOCHICK intends to reassure that all items online are in stock.

However as we are constantly updating our products and services offerings in the website, there could be flaws. BOHOCHICK remains the right to alter or update information and correct mistakes, imprecisions or omissions at any moment and without previous notice. It also holds the right to not accept orders or cancel orders previously made in case of unavailability of the article. In case of out of stock items BOHOCHICK will promptly inform the client and place refund of the value paid for that given item.

PURCHASES

Our checkout page is protected by SSL to protect credit card information. SSL (Secure Sockets Layer), is a technology that secures the connection between your browser and the website you’re visiting. 

If you wish to purchase any product or service, made available through the website you may be requested to supply certain information that is relevant to your Purchase, including, but not limited to, the name of the credit card holder, the number and expiration date, your invoicing address and shipping information.

You represent and warrant that: (1) you have the legal right to use any credit card(s) or other payment method(s) with any Purchase; and (2) that the information provided is accurate, correct and complete.

By legal imposition by the Directive on Payment Services – PSD – we are obliged to supply the information to third parties to facilitate the conclusion of the Purchases.

We reserve the right to refuse or cancel your order at any moment by certain reasons, including but not limited to: availability of the products or services, errors in the description or price of the product or service, error in your request or any other reasons.

We reserve the right to refuse or cancel your order in case there is a suspicion of fraud or unauthorised or illegal transaction.

 METHOD OF PAYMENT

 The website BOHOCHICK accepts the following methods of payment:

 The eligible methods of payment are the above and no other will be accepted. The client should pay the exact amount mentioned in the confirmation order and through the above payment services.

CONFIRMATION OR CANCELLATION

 After pursuing your purchase, the Client should check that it has received an automatic email confirming the transaction, which should be kept for future reference.

 Your order will be only issued when confirmed full payment. In case of non-payment, default or breach of contract in any of the presented terms and conditions, BOHOCHICK holds the right to not accept or to cancel the clients order even after receiving the automatic e-mail confirmation.

 In any case BOHOCHICK will inform the Client by email about the inability to proceed with the order in demand and the placement of refund concerning the payment of the articles purchased.

 There are no reservations. The non-payment in the following 24 hours of the order will be considered as a cancellation.

SHIPPING & RETURNS

 We ship worldwide by registered CTT – Correios de Portugal, SA. with tracking number.

Shipping cost is calculated at check out.

DELIVERY

 The articles order by the online shop BOHOCHICK will be sent and delivered in working days, from Monday to Friday.

 During the process of purchase it will be requested the address of delivery. For a successful delivery all information must be accurate, correct and complete. This information is of entire responsibility of the Client.

 The order is considered accepted if after receiving the order the Client does not return the order within the following 14 days.

DELIVERY TIME

 BOHOCHICK proceeds the shipping expeditions on working days. As so being the time estimated should not consider weekend days or public holydays. Any delay in delivery does not account to compensation.

 Other than festive seasons or large peak of sales, no later than 3 working days the shipping expedition will be done. In these exceptions mentioned above, the Client will be notified.

 After BOHOCHICK expedition, the order’s estimated time by the delivery service is:

 - Portugal (Mainland & Islands):  3 to 5 days

- European Union: until 20 days

 - Rest of the World: until 30 days

RETURNS & EXCHANGES

 If for some reason the Client is not happy with the purchase and wish to return or exchange it for a different item, it should be done within 14 days after reception of the order. After this period, we do not make returns or refunds.

 The item must be unused and in the same condition as it was received.

 For proceeding with any return or exchange we must be informed through the e-mail: info.bohochick@gmail.com.

​An email will be received confirming the return or exchange procedure and with the address for returned items.

​The Client is responsible for the shipping costs of the return or exchange item. We strongly advise getting tracking, as we unfortunately will not be held accountable nor reimburse for returns, which do not arrive back to BOHOCHICK.

 The refund will be placed soon after BOHOCHICK receives the item and verifies its original condition. When we receive the item we will check fully, and then refund you via the method you paid.

 BOHOCHICK reserves the right to reject a return if it does not meet the abovementioned criteria.

 If a return/exchange fails to return to us within the 14 day policy from the date you receive the order, BOHOCHICK reserves the right to refuse the return/exchange.

DISCLAIMER

BOHOCHICK has no responsibility for the misuse or ill care of the articles, as to not following the instructions of garment care or intensive usage.

We have a garment care section that we suggest consulting.

APPLICABLE LAW

These Terms will be governed and interpreted according to the law in Portugal, without considering conflicts of legal clauses.

Our incapacity to assert any right or disposition of these Terms will not be considered as a waver to these rights. If any disposition in these Terms is considered invalid or not applicable by a Court, the remaining dispositions of these Terms will remain in force. These Terms constitute the full agreement between us, as far as our Service is concerned, and replace any previous agreements we have between us regarding the Service.
